Terms of Service

These terms are an agreement between you and Pishpirik LLC ("we", "us") about using the Pishpirik game and pishpirik.com (together, "Pishpirik"). By playing, you accept them. If you do not agree, please do not play. Our Privacy Policy explains how we handle your information.

1. Who can play

• You must be at least 13 years old. In the EU and the UK, if you are under 16, you need a parent's or guardian's permission.
• If you are under 18, a parent or guardian must agree to these terms and approve any purchase.
• You may not play if the law where you live forbids it, or if we closed an account of yours before.

2. Your account

• You can play as a guest or sign in with an email address, Google or Apple. A guest account lives in the game on your device: if you delete the game or lose the device, you may lose it. You can add an email, Google or Apple sign-in to a guest account at any time to keep your progress safe.
• Keep your sign-in private. You are responsible for what happens on your account.
• Accounts are personal: you may not sell, buy, share or transfer them.
• Your account, your player name and everything in it remain part of Pishpirik; you have a right to use them under these terms.

3. Play fair

Pishpirik is only fun when everyone plays by the same rules. You may not:

• cheat, hack, or change the game, its files or its traffic, or use bots, scripts or other tools that play for you or give you an unfair edge;
• use a bug or glitch on purpose instead of reporting it to us;
• use several accounts, or play with a partner on purpose to lose, so that coins, trophies or items move to one account;
• try to get into accounts, servers or data that are not yours, or overload our services;
• buy, sell or trade coins, items or accounts outside the game.

We watch for cheating: our server keeps a record of changes to coins, items, trophies and results and flags changes the game could not have made. If we find cheating, we may, depending on how serious it is, reset coins, trophies, statistics or Pass progress gained unfairly, remove items that were not obtained in the game or paid for, limit some features, suspend the account, or close it. Where the law allows, we may act without warning, for example to stop an ongoing attack.

4. Be respectful

Your player name, your profile photo, your chat messages and your emotes must not:

• be sexual, hateful, threatening, harassing or violent;
• impersonate someone else, including Pishpirik staff;
• share someone's private information;
• advertise, spam or try to sell anything;
• break the law or someone else's rights.

Profile photos are checked before other players see them, and offensive player names are refused. Chat messages are not filtered: you can switch chat off at any time in Settings. We may remove or change any name, photo or other content, and limit or close accounts that break these rules. To report a player or anything offensive, write to support@pishpirik.com with their player name and number and what happened.

You keep the rights to the photos and text you add. You give us a worldwide, free licence to store, copy and show them to other players for as long as needed to run Pishpirik.

5. Coins, items and the Pass

• Coins and items are virtual. Coins, card backs, Pishpirik effects, emotes, Pass rewards and trophies are a limited, personal, non-transferable licence to use them in the game. They are not money and not property, have no cash value, and can never be exchanged for money, prizes or anything of real-world value, by us or anyone else.
• Coin tables. Quick matches and games with friends can be played for coins at tables of 50, 150 or 500; the higher tables unlock after a number of games played. Each player pays the table's entry. The winner receives the prize shown before the game starts: twice the entry minus the house's share, currently 15%. In 2 vs 2, each player on the winning team receives that prize. A draw gives each player a fifth of the entry back. The same two players can play each other for coins at most three times a day. These games are entertainment played only with virtual coins and offer no real-world prize.
• The Pishpirik Pass runs for a season. Its rewards can be claimed during that season; what is not claimed when the season ends may no longer be available.
• Changes. We may change prices, rewards, items, the house's share and how coins are earned or spent, to keep the game balanced. If we stop offering an item you bought with real money, we will try to give you something of similar value.
• Ending. Coins and items end when your account is deleted or closed under these terms. They are not refunded, except where the law requires it.

6. Purchases

• Purchases are made through the Apple App Store or Google Play and follow their payment and refund rules. To ask for a refund, use Apple's or Google's refund process.
• Prices are shown in the store before you buy, in your currency, with any taxes the store adds.
• A purchase is delivered to your account right away. If you live in the EU or the UK, you agree that it is delivered at once and that you therefore lose your 14-day right to withdraw once it is delivered.
• If a purchase is refunded or reversed, we may remove the coins or items it gave, or what they were used for.
• If something you paid for did not arrive, write to us with the store receipt and we will put it right.

7. Ads

You can choose to watch reward ads for free coins, up to a daily limit shown in the game. Ads are provided by Google AdMob. We are not responsible for the content of third-party ads or the sites they lead to.

8. The game can change

We keep improving Pishpirik, so features, rules, modes and content may change, and some may end. The game needs an internet connection and may sometimes be unavailable, for example during updates or outages. You may need to install updates to keep playing. If we ever stop running Pishpirik, we will announce it in the game or on pishpirik.com, with at least 30 days' notice where that is possible.

9. Ending your account

You can delete your account at any time; see Delete your account. We may suspend or close accounts that break these terms, as described in sections 3 and 4. Sections 5, 10, 11, 12 and 13 still apply after an account ends.

10. Our content

Pishpirik, its name, the eagle, the artwork, the card backs, the effects, the music and the code belong to Pishpirik LLC or its licensors. We give you a personal, limited, non-transferable, revocable licence to play the game for your own entertainment. You may not copy, sell, rent, reverse-engineer or make derivative works of it, except where the law expressly allows.

11. No guarantees

We work hard to keep Pishpirik running and fair, but we provide it "as is" and "as available". To the extent the law allows, we do not promise that it will be uninterrupted, error-free or free of harmful parts, or that your progress will never be lost.

12. Limits on our liability

To the extent the law allows, Pishpirik LLC is not liable for indirect, incidental, special or consequential losses, or for lost data, profits or goodwill, and our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim or 50 US dollars. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.

13. Law and disputes

These terms are governed by the laws of the State of North Carolina, United States, and disputes go to the state or federal courts in Mecklenburg County, North Carolina. If you are a consumer living in the EU, the UK or another country whose laws give you protections that cannot be waived, you keep those protections and may also bring a claim in the courts where you live. Before going to court, please write to us first: most problems can be solved quickly.

14. Changes to these terms

We may update these terms. If a change matters, we will tell you in the game or on pishpirik.com before it takes effect. If you keep playing after it takes effect, you accept the new terms; if you do not agree, you can stop playing and delete your account.

15. Apple and Google

If you downloaded Pishpirik from the Apple App Store:

• These terms are between you and Pishpirik LLC, not Apple. Pishpirik LLC, not Apple, is responsible for the game and its content.
• Your licence lets you use the game on Apple-branded devices you own or control, as the App Store's Usage Rules allow.
• Apple has no obligation to provide maintenance or support for the game.
• If the game fails to meet a warranty that applies by law, you may tell Apple, and Apple will refund the price you paid for the game, if any. To the extent the law allows, Apple has no other warranty obligation for the game.
• Pishpirik LLC, not Apple, handles any claims about the game, including product liability, failure to meet legal or regulatory requirements, consumer protection or privacy laws, and claims that the game infringes someone's intellectual property.
• You must also follow any third-party terms that apply when you play, such as the terms of the store you downloaded the game from.
• You confirm that you are not in a country under a US government embargo or designated as "terrorist supporting", and that you are not on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you downloaded Pishpirik from Google Play, Google Play's terms also apply to your download and purchases.

16. Everything else

If one part of these terms cannot be enforced, the rest still applies. If we do not enforce a part right away, we can still enforce it later. You may not transfer these terms to someone else; we may transfer them to a company that takes over Pishpirik. These terms and the Privacy Policy are the whole agreement between you and us about Pishpirik.
